Rubbish Removal Pimlico Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Pimlico provides rubbish removal, waste collection and related services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, firm or company requesting the services from Rubbish Removal Pimlico.

Services means any rubbish removal, waste collection, clearance, loading, transportation, recycling, disposal or related services provided by Rubbish Removal Pimlico.

Waste means any household, commercial or other non-hazardous waste accepted for removal under these Terms and Conditions.

Booking means a confirmed request for services made by the Customer and accepted by Rubbish Removal Pimlico.

Site means the property, premises or location where the services are to be carried out.

2. Scope of Services

Rubbish Removal Pimlico provides waste collection and rubbish removal services for domestic and commercial customers. The exact scope of each job will be confirmed at the time of booking or upon arrival at the site.

We will collect and remove waste as agreed, subject to any volume and weight limits discussed with the Customer. Our services may include the loading of waste from the site, transportation to an authorised facility, and disposal or recycling in accordance with applicable waste regulations.

Certain types of waste are restricted or prohibited, including but not limited to hazardous waste, clinical or medical waste, asbestos, chemicals, solvents, pressurised containers, and any items that require special handling or licensing. The Customer must inform us in advance of any waste that may be hazardous or require special handling. We reserve the right to refuse to remove waste that we reasonably believe cannot be carried or disposed of safely or legally.

3. Booking Process

Bookings may be made by telephone, email or other communication methods accepted by Rubbish Removal Pimlico. When making a booking, the Customer must provide accurate information about the type and approximate quantity of waste, the site address, access conditions, and any relevant parking or loading restrictions.

Any quote given prior to arrival at the site is based on the information provided by the Customer and is not binding if that information is incomplete or inaccurate. Upon arrival, our team will assess the waste and confirm the final price based on volume, weight, labour required and any additional services requested.

A booking is confirmed when Rubbish Removal Pimlico accepts the Customer's request for services and confirms a date and time window for attendance. We will make reasonable efforts to attend within the agreed time window, but times are approximate and may be subject to change due to traffic, operational or safety reasons.

The Customer is responsible for ensuring that a person over 18 years of age is present at the site at the time of service to grant access, confirm the scope of work and authorise the removal of waste.

4. Access, Parking and Site Conditions

The Customer must ensure that our team has safe and reasonable access to the site to carry out the services. This includes providing accurate information about access routes, stairs, lifts, narrow passages, height restrictions and any other relevant site conditions.

The Customer is responsible for arranging suitable parking for our vehicle as close as reasonably possible to the site, including any necessary permits or authorisations. Additional charges may apply where parking fees are incurred or where long carrying distances or difficult access significantly increase the time or labour required.

Rubbish Removal Pimlico reserves the right to refuse or suspend services where access is unsafe, unlawful or significantly more difficult than reasonably anticipated. In such cases, a call-out or cancellation charge may apply.

5. Pricing and Payment

Prices are generally based on the volume and type of waste, weight where relevant, the time required to carry out the work, and any special access or handling requirements. The final price will be confirmed before the work commences.

Unless otherwise agreed in writing, payment is due immediately upon completion of the services. We may accept payment by cash, card or other methods we specify. For commercial customers, credit terms may be agreed in advance, in which case invoices must be paid within the period stated on the invoice.

All prices are quoted exclusive of VAT unless stated otherwise. Where applicable, VAT will be charged at the prevailing rate.

If the Customer fails to make payment when due, Rubbish Removal Pimlico reserves the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in seeking to recover the debt, including legal and collection costs.

6. Cancellations and Amendments

The Customer may cancel or amend a booking by contacting Rubbish Removal Pimlico as soon as possible. If the Customer cancels with sufficient notice, no cancellation fee will normally apply. Where a cancellation is made at short notice, or our team has already been dispatched, we reserve the right to charge a reasonable cancellation or call-out fee to cover our costs.

Where the Customer wishes to amend the scope of the services, such as significantly increasing or decreasing the amount of waste to be collected, this must be agreed with us in advance or with our team on site. We reserve the right to revise the price to reflect any changes in the services requested.

If Rubbish Removal Pimlico needs to cancel or change a booking due to operational, safety or other reasons beyond our control, we will notify the Customer as soon as reasonably possible and offer an alternative date or time. We will not be liable for any loss arising from such cancellation or rescheduling, save for refunding any amounts already paid for services not provided.

7. Customer Obligations

The Customer must ensure that all waste intended for removal is accessible, not contaminated with prohibited items and is safe for our team to handle. Where the Customer or a third party has bagged or packaged waste, the Customer is responsible for ensuring that bags or containers are suitable and not overloaded.

The Customer warrants that they have the right to allow Rubbish Removal Pimlico to access the site and remove the waste. The Customer shall indemnify Rubbish Removal Pimlico against any claims arising from a lack of proper authority or any dispute over ownership of items removed.

The Customer must not ask our team to break the law, for example by removing prohibited waste, fly-tipping, or trespassing on neighbouring property. Where the Customer requests anything unlawful, we will refuse and may withdraw services immediately, with any reasonable costs incurred charged to the Customer.

8. Waste Handling and Regulations

Rubbish Removal Pimlico will handle, transport and dispose of waste collected as part of our services in accordance with applicable UK waste management laws and regulations. We will use authorised waste transfer, recycling and disposal facilities and maintain appropriate records as required.

The Customer must cooperate with any information we reasonably require to comply with waste regulations, including describing the type of waste and confirming that no hazardous or restricted materials are present. If hazardous or prohibited waste is discovered among the items to be removed, we may refuse to take it, or if already taken, we may return it to the site or charge additional fees for specialised handling and disposal.

We aim to minimise the amount of waste sent to landfill and may separate or sort materials for recycling or reuse where operationally practical. The Customer acknowledges that final decisions on disposal routes are at the discretion of Rubbish Removal Pimlico subject to regulatory requirements.

9. Liability and Limitation of Liability

Rubbish Removal Pimlico will exercise reasonable care and skill in providing the services. However, the Customer is responsible for identifying and protecting any fragile, high-value or easily damaged items at the site and for clearly instructing our team as to what should and should not be removed.

We will not be liable for the removal of items that the Customer failed to identify as not to be taken, where those items were reasonably indistinguishable from waste or were placed with items marked for disposal.

While working on the site, our team will take reasonable precautions to avoid damage to property. The Customer must notify us of any damage allegedly caused by our team in writing within 48 hours of completion of the services, providing reasonable details. We may request access to inspect the damage before any repair or remedial work is undertaken.

Except where liability cannot lawfully be excluded or limited, Rubbish Removal Pimlico shall not be liable for any indirect, consequential, or purely economic loss, including loss of profit, loss of business, or loss of opportunity. Our total aggregate liability arising out of or in connection with any booking shall not exceed the total price paid or payable by the Customer for the relevant services.

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

10. Insurance

Rubbish Removal Pimlico maintains public liability and, where applicable, employer's liability insurance to a reasonable level in line with industry standards. Details of our insurance cover are available on request.

11. Complaints and Disputes

If the Customer is dissatisfied with any aspect of the services, they should contact Rubbish Removal Pimlico as soon as possible with full details of the issue. We will investigate and aim to resolve complaints promptly and fairly.

In the event of a dispute that cannot be resolved directly between the parties, either party may consider using mediation or another form of alternative dispute resolution. This does not affect the right of either party to bring legal proceedings in the courts.

12. Force Majeure

Rubbish Removal Pimlico shall not be in breach of these Terms and Conditions or liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control. Such events may include, but are not limited to, extreme weather, transport disruption, accidents, fire, flood, strikes, acts of government or public authorities, or other emergencies.

13. Data Protection and Privacy

Rubbish Removal Pimlico may collect and process personal data about the Customer for the purposes of managing bookings, providing services, processing payments and handling enquiries or complaints. We will handle such data in accordance with applicable data protection laws and will only use it for legitimate business purposes.

By making a booking, the Customer consents to the use of their contact details for communication in relation to the services. The Customer may request access to or correction of their personal data held by us, subject to legal limitations.

14. Intellectual Property

All content, branding and materials associated with Rubbish Removal Pimlico, including any descriptions of services, text and logos, remain the property of Rubbish Removal Pimlico or its licensors. No licence to use such intellectual property is granted except as necessary for the Customer to receive the services.

15. Variation of Terms

Rubbish Removal Pimlico reserves the right to amend or update these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that booking, unless a change is required by law or regulation.

16. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as deleted, but this shall not affect the validity and enforceability of the remaining provisions.

17. Entire Agreement

These Terms and Conditions, together with any written confirmation of booking and any agreed written variations, constitute the entire agreement between Rubbish Removal Pimlico and the Customer in relation to the services and supersede any prior understandings, statements or agreements.

18. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided by Rubbish Removal Pimlico.
